Storage Unit Rental Agreement Terms and Conditions

⚠️ IMPORTANT INSURANCE NOTICE

VALLEY MINI STORAGE STRONGLY RECOMMENDS THAT ALL TENANTS OBTAIN INSURANCE FOR THEIR STORED PROPERTY.

  • We are NOT responsible for theft, damage, or loss of stored items
  • Our facility insurance does NOT cover your belongings
  • You store property at your own risk
  • Please obtain tenant insurance to protect your belongings

1. AGREEMENT TO TERMS

By renting a storage unit from Valley Mini Storage ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms") and your signed Rental Agreement. These Terms are governed by Tennessee law, specifically the Tennessee Self-Service Storage Facility Act (T.C.A. § 66-31-101 et seq.).

You must be at least 18 years old and have legal capacity to enter into a binding contract to rent a storage unit.

2. RENTAL TERMS AND CONDITIONS

Month-to-Month Rental

All rentals are on a month-to-month basis. Either party may terminate the rental agreement with proper written notice as required by Tennessee law.

Payment Terms

  • Rent is due on the same day each month as your move-in date
  • A 5-day grace period is provided
  • Late fees apply after the grace period
  • Payment methods accepted: cash, check, credit/debit card
  • Returned check fee: $35.00

Unit Use Restrictions

You may NOT store:

  • Hazardous materials, explosives, or flammable items
  • Illegal substances or stolen property
  • Perishable items or food
  • Living creatures (no persons or animals may inhabit units)
  • Firearms or ammunition (unless legally permitted and properly secured)
  • Any items prohibited by law

3. ACCESS HOURS AND RESTRICTIONS

Unit Access: DAYLIGHT HOURS ONLY

For safety and security reasons, access to storage units is permitted during daylight hours only, typically from dawn to dusk. No nighttime access is permitted.

Office Hours

  • Monday - Friday: 9:00 AM - 5:00 PM
  • Saturday: 9:00 AM - 12:00 PM
  • Sunday: Closed

Management reserves the right to deny access in cases of:

  • Delinquent account status
  • Safety concerns
  • Emergency situations
  • Maintenance requirements

4. SECURITY AND LIABILITY LIMITATIONS

NO LIABILITY FOR LOSS OR DAMAGE

VALLEY MINI STORAGE IS NOT LIABLE FOR ANY LOSS, DAMAGE, OR THEFT OF STORED PROPERTY.

Tenant Responsibilities

  • You provide your own lock and maintain sole access
  • You are responsible for insuring your stored property
  • You assume all risk of loss or damage to stored items
  • You must maintain the unit in clean condition

Facility Features

While we maintain certain security measures including video surveillance, these are for facility management purposes and do not guarantee the safety of stored property. Features include:

  • Video recording system (retention period varies)
  • Facility lighting
  • On-site management during office hours
  • Gravel driveways and paths

WE DO NOT GUARANTEE:

  • Protection against theft or break-ins
  • Protection from weather (standard storage units)
  • Protection from pests or rodents
  • Protection from Acts of God or natural disasters

5. LIEN RIGHTS AND PROPERTY DISPOSAL

Under Tennessee Self-Service Storage Facility Act, Valley Mini Storage has a lien on all personal property stored in the leased space for rent, labor, or other charges related to the stored property.

Default and Lien Enforcement

If rent is unpaid for 30 days after the due date, we may:

  • Deny access to the unit
  • Send written notice of lien and intent to sell
  • After proper notice (as required by Tennessee law), sell property at public auction
  • Dispose of property with no commercial value

Notice Requirements

Before sale or disposal, we will:

  • Send written notice to your last known address
  • Provide at least 10 days notice before sale
  • Advertise the sale in a local newspaper (if required)

You may redeem your property any time before sale by paying all amounts owed.

6. INSURANCE REQUIREMENTS

INSURANCE IS STRONGLY RECOMMENDED

Valley Mini Storage's insurance does NOT cover tenant property. You are required to:

  • Either provide proof of insurance coverage for stored items, OR
  • Sign a waiver acknowledging you understand the risks of storing without insurance
  • Understand that you bear all risk of loss

7. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Valley Mini Storage, its owners, employees, and agents from any and all claims, losses, damages, or expenses (including attorney's fees) arising from:

  • Your use of the storage unit
  • Your stored property
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Injury to persons or property caused by you or your invitees

8. TERMINATION

By Tenant

You may terminate your rental by:

  • Providing written notice
  • Removing all property from the unit
  • Returning the unit in clean, empty condition
  • Paying all amounts owed

By Valley Mini Storage

We may terminate your rental for:

  • Non-payment of rent
  • Violation of these Terms
  • Illegal activities
  • Creating safety hazards
  • Misrepresentation on rental application

9. MAINTENANCE AND REPAIRS

Valley Mini Storage will maintain the facility in reasonable condition. However:

  • We are not responsible for conditions beyond our control
  • Temporary interruptions for maintenance may occur
  • You must report any damage or needed repairs promptly
  • You are responsible for damage you cause to the unit

10. PRIVACY AND SURVEILLANCE

By renting from us, you acknowledge:

  • Video surveillance operates on the premises
  • Recordings may be used for security and legal purposes
  • We may enter your unit with proper notice or in emergencies
  • We cooperate with law enforcement as required by law

11. COMPLIANCE WITH LAWS

You must comply with all applicable federal, state, and local laws, including:

  • Tennessee Self-Service Storage Facility Act
  • Local zoning and use regulations
  • Environmental protection laws
  • All other applicable regulations

12. DISPUTE RESOLUTION

Any disputes arising from these Terms or your rental shall be:

  • First attempted to be resolved through good faith negotiation
  • Subject to the laws of Tennessee
  • Brought in the courts of Franklin County, Tennessee

Each party shall bear their own attorney's fees unless otherwise provided by law.

13. MISCELLANEOUS PROVISIONS

Entire Agreement

These Terms and your signed Rental Agreement constitute the entire agreement between parties.

Severability

If any provision is found invalid, the remaining provisions shall continue in full force.

No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

Notices

All notices must be in writing and sent to the addresses on file.

Changes to Terms

We may modify these Terms with 30 days written notice to tenants.

15. ACKNOWLEDGMENT AND ACCEPTANCE

By signing a Rental Agreement and/or using our storage facilities, you acknowledge that you have:

  • Read and understood these Terms of Service
  • Had the opportunity to ask questions
  • Agree to be bound by these Terms
  • Understand the importance of obtaining insurance
  • Accept all risks associated with storage

Valley Mini Storage is not responsible for any loss, theft, or damage to your stored property. Insurance is your only protection.
